Basic *(incomplete)* DMCA for OpenUserJS#116
@sizzlemctwizzle We need to decide if email is enough or an actual physical PO Box to send these in. Issue tickets should not be used since there is no verification of their identity for legal purposes.

# Digital Millenium Copyright Act

## Filing a Notification
A written notification must be made. This can be done by written letter (mail). Emails or faxes will not be accepted unless a prior arrangement has been made. The notification must:
1. Identify in sufficient detail the copyrighted work that you believe has been infringed upon *(i.e., describe the work that you own)*.
2. Identify the item that you claim is infringing on your copyright, and provide information reasonably sufficient to locate the item. For example "The allegedly infringing work I am referring to is located at the URL ..."
3. Provide a reasonably sufficient method of contacting you; phone number and email address would be preferred along with mailing address.
4. *(Optional)* Provide information, if possible, sufficient to permit identification of the content that allegedly contains infringing material. You may also provide screenshots or other materials that are helpful to identify the works in question. *(This is for identification only, not to "prove" substantive claims.)*
5. Include the following statement: "I have good faith belief that the use of the copyrighted materials described above and contained on the service is not authorized by the copyright owner, its agent, or by protection of law."
6. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
7. Sign the paper | ||
Please note: The DMCA provides that you may be liable for damages *(including costs and attorneys fees)* if you falsely claim that an item is infringing your copyrights. We recommend contacting an attorney if you are unsure whether an item is protected by copyright laws.
## Send the written document to the designated address at:
*TO BE ANNOUNCED* | ||
## Counter Notification
A counter notification may be issued in the event there is a need for dispute resolution.

As far as I know, DMCA takedown notices are usually sent via email and I don't want to set up a PO box anyway. I guess you could use my email address for now since I own the domain and pay for the hosting.

Well at worst case if these come through they can appropriately contact your domain provider contact info or one tier up hosting. These docs are meant to protect you. TDNs aren't as valid when served via email but they can work... a well established CONTRIBUTING.md should clear up any site related issues pertaining to administration. As far as the repository here goes it's appropriately licensed so there shouldn't need to be anything specific to GH.
I would however suggest an email alias in the short term and long term do something like USO did with support... legal counsel can not badger anyone for any reason and needs to take the appropriate civil remedies... if you don't supply this information you are effectively saying take it up one tier.
I'll work on the rewording in the next few days but let me know precisely the contact information you want in the TO BE ANNOUNCED section and any other changes you may think of.
