There is no function of empty text elements to expect. <tspan></tspan> E.q. also self-closing tags <tspan/> <text/> with any attributes.
This is not a rare case as I seen on Wikimedia Commons.

This is already implemented in a dev version and will be available soon.

In the current dev-version <tspan></tspan> will be replaced by <tspan/>, but it won't get removed.
