Why should the side bar be closed? If we are annotating or sharing annotations it makes sense to have this open. This makes it less likely to be confused for the original site.

Totally agree. The current sidebar-closed-by-default behaviour is a problem for multiple reasons:
It makes it more likely that people won't realise that they're on our proxied version of a page. Makes it easier for people to get phished etc.
It makes it less likely that people will realise that they can annotate the page, or generally that they'll realise that there's an annotation tool on this page or will understand what the link actually is. To annotate you have to spot the thin, light line down the right-hand-side and understand that it's not just a part of the page and is something you should click on
Even if the user knows exactly what's happening we're arguably just making them do an extra click to open the sidebar before they can view or create annotations
Closed-by-default shouldn't even be possible as an option in Via (since if it is, phishing attacks could use it)
+1 on always opening sidebar in Via. The reason we have a proxy service is to support making annotations. The ability to do so should be front and center.
