scheduler.max_active.set didn't work properly

I have this line scheduler.max_active.set = 5 and/or scheduler.max_active.set = 5
When I have 5 active torrents, I am adding new torrents and they are stopped. Next I pauses/stopping one of the active and the rest of latest added now starting, and then I have for example 8 active torrents with line above.

My rTorrent version is 0.8.9

Yeah, pyroscope is a great app, but I'm using a virtual rpc to connect rtorrent with rutorrent web-interface and I have eight of them running on different users.

I'm still waiting for patch/fix or software upgrade containing the patch.
